General Terms

1. Basic Terms

Content posted other than a Comment to an existing post is called an Opinion. An Opinion post contains a required Title. You are responsible for any content you post on WorldOfOpinion.com either Opinions or Comments. You must be a registered user to be able to post an Opinion or Comment. Most Content you post on WorldOfOpinion.com is public by default and can be viewed by other users who access WorldOfOpinion.com whether they are registered users or not. As you are responsible for any Content that you post, you must feel comfortable sharing with others such Content. Otherwise, please do not post. There is no private setting where your Content can become available to users of your choice or hidden in any way.

You may use WorldOfOpinion.com only if you can form a binding contract with WorldOfOpinion.com and are not a person barred from using WorldOfOpinion.com under the laws of the United States, other applicable jurisdiction and for violating any WorldOfOpinion.com policies. If you are accepting these Terms and using WorldOfOpinion.com on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so. You may use WorldOfOpinion.com only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations.

As with any Internet based social media sites, changes may happen to what is provided and available to you as a user. Such changes may come into effect without prior notice to you. WorldOfOpinion.com keeps the right to limit its use by you at its sole discretion at any time without prior notice to you.

While users like you post content (if a registered user) and be able to read all posted content including comments (for this, you don’t need to be a registered user), you may also sense advertisements placed in WorldOfOpinion.com by WorldOfOpinion.com and its third party partners and providers. By using WorldOfOpinion.com, you agree that exposure to such advertisements are part of the WorldOfOpinion.com usage. Note that at this time there are no advertisements on WorldOfOpinion.com but the above statements in this paragraph are announced in anticipation of potential, future advertisements on WorldOfOpinion.com.

2. Privacy

Any information that you or other users provide to WorldOfOpinion.com is subject to our Privacy Policy, which governs our collection and use of your information. You understand that through your use of WorldOfOpinion.com you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States, and/or other countries for storage, processing and use by WorldOfOpinion.com. Please note that Privacy Policy is shown following the Terms.

3. Passwords

It is your responsibility to protect/safeguard your Password, necessary to use WorldOfOpinion.com. We strongly encourage you to create robust Passwords that contain a combination of upper and lower case letters, numbers and allowed symbols to associate with your WorldOfOpinion.com user account. WorldOfOpinion.com cannot and will not be liable for any loss or damage arising from your failure to comply with the above. Additionally, while we take measures to protect user Passwords, with hackers on the loose in the Internet world, it may not always be possible to protect passwords 100% at all times. Thus WorldOfOpinion.com cannot and will not also be liable for any loss or damage due to hacking.

4. Content

All Content (both Opinions and Comments) that gets published by a user in WorldOfOpinion.com is the sole responsibility of the user who posts it. While based on Content related policy described in the WorldOfOpinion.com Rules we may prevent some Content from being published, we generally may not monitor or control Content posted by users and do not take responsibility for such Content. Any use or reliance on posted Content in WorldOfOpinion.com by you is at your own risk.

We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content posted in WorldOfOpinion.com. You understand that by using WorldOfOpinion.com, you may be exposed to Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. Under no circumstances will WorldOfOpinion.com be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted.

5. Your Rights

You retain your rights to any Content you post on WorldOfOpinion.com. By posting the Content, you grant us a worldwide, nonexclusive, royalty-free license (with the right to sub-license) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (currently known or developed in future).

You agree that this license includes the right for WorldOfOpinion.com to provide, promote, and improve WorldOfOpinion.com and to make the posted Content available to other companies, organizations or individuals who partner with WorldOfOpinion.com for the syndication, broadcast, distribution or publication of such Content on other media and services, subject to our terms and conditions for such Content use.

Such additional uses by WorldOfOpinion.com, or other companies, organizations or individuals who partner with WorldOfOpinion.com, may be made with no compensation paid to you with respect to the Content that you post on WorldOfOpinion.com.

We may modify or adapt your Content in order to transmit, display or distribute it over computer networks and in various media and/or make changes to your Content as are necessary to conform and adapt that Content to any requirements or limitations of any networks, devices, services or media.

You are responsible for the Content you post in WorldOfOpinion.com, and for any consequences thereof, including the use of your Content by other users and our third party partners.

You understand that your Content may be syndicated, broadcast, distributed, or published by our partners and if you do not have the right to post Content for such use, it may subject you to liability. WorldOfOpinion.com will not be responsible or liable for any use of your Content by WorldOfOpinion.com in accordance with these Terms. You represent and warrant that you have all the rights, power and authority necessary to grant the rights granted herein to any Content that you post.

6. Your License to Use WorldOfOpinion.com

WorldOfOpinion.com gives you a personal, worldwide, royalty-free, non-assignable and nonexclusive license to use the software that is provided to you by WorldOfOpinion.com to post your Content. This license is for the sole purpose of enabling you to use WorldOfOpinion.com as provided by WorldOfOpinion.com, in the manner permitted by the Terms.

7. WorldOfOpinion.com Rights

All right, title, and interest in and to WorldOfOpinion.com (excluding Content provided by users) are and will remain the exclusive property of WorldOfOpinion.com and its licensors. WorldOfOpinion.com is protected by copyright, trademark, and other laws of both the United States and foreign countries. Nothing in the Terms gives you a right to use the WorldOfOpinion.com name or any of the WorldOfOpinion.com trademarks, logos, domain names, and other distinctive brand features, where applicable. Any feedback, comments, or suggestions you may provide regarding WorldOfOpinion.com is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.

8. Restrictions on Content and Use of WorldOfOpinion.com

Please review the WorldOfOpinion.com Rules (which are part of the WorldOfOpinion.com Terms and Conditions) to better understand what is prohibited on WorldOfOpinion.com. We reserve the right at all times (but will not have an obligation) to remove or refuse to distribute any Content on WorldOfOpinion.com, to suspend or terminate user accounts, and to reclaim usernames without liability to you. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the WorldOfOpinion.com Terms and Conditions, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of WorldOfOpinion.com, its users and the public.

You may not do any of the following while accessing or using WorldOfOpinion.com: (i) access, tamper with, or use nonpublic areas of WorldOfOpinion.com, WorldOfOpinion.com computer systems, or the technical delivery systems of WorldOfOpinion.com providers; (ii) probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures; (iii) access or search or attempt to access or search WorldOfOpinion.com by any means (automated or otherwise) other than through using WorldOfOpinion.com Search interface; (iv) forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use WorldOfOpinion.com to send altered, deceptive or false source-identifying information; or (v) interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, mail-bombing WorldOfOpinion.com, or by scripting the creation of Content in such a manner as to interfere with or create an undue burden on WorldOfOpinion.com.

9. Copyright Policy

WorldOfOpinion.com respects the intellectual property rights of others and expects users of WorldOfOpinion.com to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that your Content has been copied in a way that constitutes copyright infringement, please provide us with the following information: (i) an electronic signature of the copyright owner or a person authorized to act on their behalf; (ii) identification of the copyrighted work claimed to have been infringed; (iii) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material; (iv) your contact information, including your address, telephone number, and an email address; (v) a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (vi) a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner. We reserve the right to remove Content alleged to be infringing without prior notice, at our sole discretion, and without liability to you. In appropriate circumstances, WorldOfOpinion.com will also terminate a user’s account if the user is determined to be a repeat infringer. 10. Ending These Terms

The Terms will continue to apply until terminated by either you or WorldOfOpinion.com as follows: You may end your legal agreement with WorldOfOpinion.com at any time for any or no reason by deactivating your account and discontinuing your use of WorldOfOpinion.com. You do not need to specifically inform WorldOfOpinion.com when you stop using the WorldOfOpinion.com.

However, if you would like to deactivate your account, such that your login credentials (your Username and Password) are no longer in WorldOfOpinion.com as “current user” and that you would not be able to log in anymore, you would need to do the following: You may request deactivating your account by writing to [email protected]. The request to deactivate must come from the same email address that is associated with your account. In the request, your must also refer to your Username so that we can verify that your Email Address and the Username are tied to your account. Please note that we will try our best to deactivate as soon as we can.

We may suspend or terminate your account or cease providing you with all or part of what WorldOfOpinion.com provides at any time for any or no reason, including, but not limited to, if we reasonably believe: (i) you have violated these Terms or WorldOfOpinion.com Rules, (ii) you create risk or possible legal exposure for us; or (iii) our provision of WorldOfOpinion.com to you is no longer commercially viable. We will make reasonable efforts to notify you by the email address associated with your account or the next time you attempt to access your account.

In all such cases, these Terms shall terminate, including, without limitation, your license to use WorldOfOpinion.com, except that the following sections shall continue to apply: 4, 5, 7, 8, 10, 11, and 12.

Nothing in this section shall affect WorldOfOpinion.com’s rights to change, limit or stop the provision of WorldOfOpinion.com without prior notice, as provided above in section 1 (Basic Terms).

11. Disclaimers and Limitations of Liability

Please read this section carefully since it limits the liability of WorldOfOpinion.com and its parents, subsidiaries, affiliates, related companies, officers, directors, employees, agents, representatives, partners, and licensors (collectively, the “Entities”, if and when they come into existence). Each of the subsections below only applies up to the maximum extent permitted under applicable law. Some jurisdictions do not allow the disclaimer of implied warranties or the limitation of liability in contracts, and as a result the contents of this section may not apply to you. Nothing in this section is intended to limit any rights you may have which may not be lawfully limited.

WorldOfOpinion.com is Available “AS IS”

Your access to and use of WorldOfOpinion.com or any Content are at your own risk. You understand and agree that WorldOfOpinion.com is provided to you on an “AS IS” and “AS AVAILABLE” basis. Without limiting the foregoing, to the maximum extent permitted under applicable law, WorldOfOpinion.com disclaims all warranties and conditions, whether express or implied, of merchantability, fitness for a particular purpose, or non-infringement.

WorldOfOpinion.com makes no warranty or representation and disclaim all responsibility and liability for: (i) the completeness, accuracy, availability, timeliness, security or reliability of WorldOfOpinion.com or any Content; (ii) any harm to your computer system, loss of data, or other harm that results from your access to or use of WorldOfOpinion.com or any Content; (iii) the deletion of, or the failure to store or to transmit, any Content and other communications maintained by WorldOfOpinion.com; and (iv) whether WorldOfOpinion.com will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained through WorldOfOpinion.com, will create any warranty or representation not expressly made herein.

You acknowledge and agree that WorldOfOpinion.com is not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by WorldOfOpinion.com of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.

Limitation of Liability

To the maximum extent permitted by applicable law, WorldOfOpinion.com shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties; (iii) any content obtained from WorldOfOpinion.com; or (iv) unauthorized access, user or alteration of your transmissions or content.

12. General Terms

Waiver and Severability

The failure of WorldOfOpinion.com to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. In the event that any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of the Terms will remain in full force and effect.

Controlling Law and Jurisdiction

The Terms and any action related thereto will be governed by the laws of the State of Oregon without regard to or application of its conflict of law provisions or your state or country of residence. All claims, legal proceedings or litigation arising in connection with WorldOfOpinion.com will be brought solely in the federal or state courts located in Washington County, Oregon, United States, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum.

If you are a federal, state, or local government entity in the United States using WorldOfOpinion.com in your official capacity and legally unable to accept the controlling law, jurisdiction or venue clauses above, then those clauses do not apply to you. For such U.S. federal government entities, the Terms and any action related thereto will be governed by the laws of the United States of America (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the State of Oregon (excluding choice of law).

Entire Agreement

The WorldOfOpinion.com Terms and Conditions, including the WorldOfOpinion.com Rules for WorldOfOpinion.com use, and the WorldOfOpinion.com Privacy Policy are the entire and exclusive agreement between WorldOfOpinion.com and you regarding WorldOfOpinion.com use, and they supersede and replace any prior agreements between WorldOfOpinion.com and you regarding WorldOfOpinion.com use. Other than members of WorldOfOpinion.com team, no other person or company will be third party beneficiaries to the WorldOfOpinion.com Terms and Conditions.

We may revise the WorldOfOpinion.com Terms and Conditions from time to time; the most current version will always be at https://worldofopinion.com/terms-conditions/. By continuing to access or use WorldOfOpinion.com after those revisions become effective, you agree to be bound by the revised version of the WorldOfOpinion.com Terms and Conditions. Basic Account Information

When you create or reconfigure an account, you provide some personal information, such as your email address, username, or password. On WorldOfOpinion.com, your username is listed publicly, including in search results. And as referred elsewhere, for accessing, reading and commenting on WorldOfOpinion.com you do not require registration.

Opinions, Opinion Titles, Comments and other Public Information

WorldOfOpinion.com is primarily designed for users to say what they like (Opinions) relative to available Opinion Categories in World of Opinion.com sharing it with the world, thus making them public. And user Comments published on WorldOfOpinion.com are also shared with the world and become public. Additionally, other information that becomes public is that which is associated with your Opinions and Comments such as metadata (e.g., time of posting). We may use this information to make inferences, like what topics are trending and based on which we may customize ads that get displayed (whenever, we introduce ads in WorldOfOpinion.com – currently we do not show ads). Our default is almost always to make the information you provide through WorldOfOpinion.com public for as long as you do not delete it where you can. Given that the information you provide becomes public, you should think carefully about what you are making public.

Location Information

WorldOfOpinion.com may receive information about your location. For example, you may choose to publish your location in your Opinions. We may also determine location by using other data from your device, such as precise location information from GPS, information about wireless networks or cell towers near your mobile device, or your IP address. While currently we don’t use the location information, if any, in future we might use for purposes such as providing relevant ads to the users.

Links

WorldOfOpinion.com may keep track of how you interact with links across WorldOfOpinion.com, including any email notifications we send, by redirecting clicks or through other means. We do this to help improve WorldOfOpinion.com, to provide more relevant advertising, and to be able to share aggregate click statistics such as how many times a particular link was clicked on.

Cookies

Like many websites, we may use cookies and similar technologies to collect additional website usage data to improve WorldOfOpinion.com, but we do not require cookies for many parts of WorldOfOpinion.com such as searching. However, nothing in this Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your information.

Business Transfer

In the event that WorldOfOpinion.com is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction.

Non-Private or Non-Personal Information

We may share or disclose your non-private, aggregated or otherwise non-personal information, such as your Opinions, the Content you follow on WorldOfOpinion.com, or the number of users who clicked on a particular link (even if only one did), or reports to advertisers about unique users who saw or clicked on their ads after we have removed any private personal information (such as your name or contact information).

Modification, Deactivation and Deletion of Your Account

If you are a registered user of WorldOfOpinion.com, it allows you to modify your account to the extent of changing your password. As a registered user of WorldOfOpinion.com, while you may not directly cancel your account, you may stop using it (i.e., stop posting Opinions or Comments) and if the disuse lasts at least one year on a continuous basis, WorldOfOpinion.com might deactivate your account and permanently delete it. Deactivation and deletion of your account amounts to you not having an account to log in and use WorldOfOpinion.com for the purposes of posting Opinions and Comments. However, your previously submitted Content will remain in WorldOfOpinion.com. Alternatively you may request deletion of your account by writing to [email protected]; you must send the request from the Email address associated with your account and that you must also refer to the Username associated with the account. Please note that we will try our best to delete as soon as we can.

Our Policy Towards Children

WorldOfOpinion.com is not directed to persons under 13 years of age. If you become aware that your child who is under 13 years (whether you are the child’s custodial parent or legal guardian with custodial rights, in lieu of the custodial parents) has provided us with personal information without your consent, please write us about it to: [email protected] so that we may delete their account if such request is made from the account holder’s email. The onus is on you to ensure that the account holder, who is your child of under 13 years, does not use the account. We do not knowingly collect personal information from children under 13 years of age. If we become aware that a child under 13 years has provided us with personal information, we take steps to remove such information and terminate the child’s account.

Changes to this Policy

We may revise this Policy from time to time. The most current version of the Policy will govern our use of your information and will always be at this location (https://worldofopinion.com/terms-conditions/). By continuing to access or use WorldOfOpinion.com after those changes become effective, you agree to be bound by the revised Policy.

The WorldOfOpinion.com Rules

We believe that everyone should have the power to create and share ideas and information instantly, without barriers. In order to protect the experience and safety of people who use WorldOfOpinion.com, there are some limitations on the type of Content and behavior that we allow. All users must adhere to the policies set forth in the WorldOfOpinion.com Rules. Failure to do so may result in the temporary locking and/or permanent suspension of account(s). Please note that we may need to change these rules from time to time and reserve the right to do so. Content Boundaries and Use of WorldOfOpinion.com

In order to make available WorldOfOpinion.com and the ability to publish Opinions and Comments, there are some limitations on the type of content that can be published in WorldOfOpinion.com.

● Trademark: We reserve the right to reclaim usernames on behalf of businesses or individuals that hold legal claim or trademark on those usernames. Accounts using business names and/or logos to mislead others may be permanently suspended.

● Copyright: We reserve the right to temporarily lock or permanently suspend any Copyright infringements, if we believe that is the case based on information provided to us by the legal owners of the Copyright that is being infringed.

● Unlawful use: You may not use WorldOfOpinion.com for any unlawful purposes or in furtherance of illegal activities. International users agree to comply with all local laws regarding online conduct and acceptable content.

Abusive Behavior

We believe in freedom of speech and expression, but that means little as an underlying philosophy if voices are silenced because people are afraid to speak up. ● Violent threats (direct or indirect): You may not make threats of violence or promote violence, including threatening or promoting terrorism.

● Harassment: You may not incite or engage in the targeted abuse or harassment of others. Some of the factors that we may consider when evaluating abusive behavior include:

if a primary purpose of the reported account is to harass or send abusive messages to others;
if the reported behavior includes threats;
if the reported account is inciting others to harass another account; and
if the reported account is sending harassing messages to an account from multiple accounts.

● Hateful conduct: You may not promote violence against or directly attack or threaten other people on the basis of race, ethnicity, national origin, sexual orientation, gender, gender identity, religious affiliation, age, disability, or disease. We also do not allow accounts whose primary purpose is inciting harm towards others on the basis of these categories.

● Multiple account abuse: Creating multiple accounts with overlapping uses or in order to evade the temporary or permanent suspension of a separate account is not allowed.

● Private information: You may not publish or post other people’s private and confidential information, such as credit card numbers, street address, or Social Security/National Identity numbers, without their express authorization and permission.

● Impersonation: You may not impersonate others while using WorldOfOpinion.com in a manner that is intended to or does mislead, confuse, or deceive others.

Spam

We strive to protect people on WorldOfOpinion.com from technical abuse and spam. Any accounts engaging in the activities specified below may be temporarily locked or subject to permanent suspension.

● Username squatting: You may not engage in username squatting. Accounts that are inactive for more than one year may also be removed without further notice. Some of the factors we take into consideration when determining what conduct is considered to be username squatting are:

the number of accounts created;
creating accounts for the purpose of preventing others from using those account names;
creating accounts for the purpose of selling those accounts; and
using feeds of third-party content to update and maintain accounts under the names of those third parties.

● Invitation spam: You may not use in anyway addresses from WorldOfOpinion.com to send repeat, mass invitations.

● Selling usernames: You may not buy or sell WorldOfOpinion.com usernames.

● Malware/Phishing: You may not publish or link to malicious content intended to damage or disrupt another person’s browser or computer or to compromise a person’s privacy.

● Spam: You may not use WorldOfOpinion.com for the purpose of spamming anyone. What constitutes “spamming” will evolve as we respond to new tricks and tactics by spammers. Some of the factors that we take into account when determining what conduct is considered to be spamming are:

if a large number of spam complaints have been filed against you;
if you post duplicate content over multiple accounts or multiple duplicate updates on one account;
if you post multiple unrelated updates to a published Opinion and its Title;
if you send large numbers of duplicate replies (Comments);
if you repeatedly create false or misleading Content;
if you repeatedly post other people’s account information as your own (bio, Opinions, etc.);
if you post misleading links (e.g., affiliate links, links to malware/clickjacking pages, etc.);
if you are creating misleading accounts.

Accounts created to replace suspended accounts will be permanently suspended.

Accounts under investigation may be removed from search for quality. WorldOfOpinion.com reserves the right to immediately terminate your account without further notice in the event that, in its judgment, you violate the WorldOfOpinion.com Terms and Conditions.
